Upon purchase, the risk of the object of sale transfers to the buyer.
In the event of a legal dispute, regardless of reason or cause, the buyer agrees that the exclusive jurisdiction for the first trial shall be the court with jurisdiction over the seller's current address, and that they will file suit in said court. The exclusive jurisdiction agreement shall apply to matters outside of this transaction as well.
If litigation is to be heard in a court other than the one with jurisdiction over the seller's current address, the buyer shall be obligated to withdraw the lawsuit and waive the rights pertaining to the subject matter of said lawsuit.
The seller may cancel the transaction at any time for reasons attributable to the seller, without the buyer's consent.
Cancellations may be made by the seller without prior notice, regardless of whether the buyer is at fault.
The maximum amount of damages the buyer can claim in a dispute arising from this transaction, whether for breach of contract or tort, shall be limited to the total of the winning bid amount and shipping costs.
The buyer shall bear the costs of restoration to the original condition due to cancellation, and any other related fees.
If pursuing the seller's liability, the buyer shall bear the burden of proof for any claim and must provide evidence that leaves no room for reasonable doubt.
The buyer shall bear full responsibility for all issues inherent in transactions between parties, regardless of where responsibility lies.
If any monetary exchange, such as a refund, becomes necessary due to circumstances arising from this agreement, the exchange shall be conducted between Japan Post Bank accounts, regardless of the seller's culpability.
If, for any reason, the buyer needs to ship an item to the seller, the seller shall choose the shipping method, regardless of the seller's culpability for the circumstances that necessitated the shipment.
If, for any reason, the buyer needs to ship an item to the seller, and the seller is culpable for the circumstances that necessitated the shipment, the seller shall be deemed to have fulfilled their obligation by paying the shipping costs only. The seller shall not incur any liability to the buyer for any other actions necessary for the shipment, such as packing and shipping, by the buyer.
